Agreement
These Terms of Service ("Terms") govern your access to and use of the Battleborn LV Landscaping website at www.battlebornlvlandscaping.com (the "Site") and any landscaping services we provide to you (the "Services"). By using the Site, submitting a request through our estimate form, or engaging us to perform work, you agree to these Terms.
About us

Estimates and quotes
Estimates provided through our website, phone, text, or email are free and non-binding until both parties confirm the scope, price, and schedule in writing (including text or email). Quotes are based on the information you provide about your property; conditions found on-site that materially differ from what was described may adjust the final price.
Scheduling and cancellations
We will schedule Services in the order requests are confirmed, weather permitting. If you need to reschedule or cancel a booked visit, please give us at least 24 hours' notice by phone or text. Repeated same-day cancellations may result in a trip fee for future visits.
Access to your property
You are responsible for providing safe and reasonable access to the work area on the day of service, including unlocking gates, securing pets, and moving personal items out of the work area unless you have arranged otherwise with us.
Payment
Unless we agree otherwise in writing, payment is due upon completion of each visit. We accept cash, check, and card. Recurring service customers may be invoiced monthly. Past-due invoices may accrue a late fee at the maximum rate allowed under Nevada law. If we must engage a collection service or pursue legal action to recover unpaid amounts, you agree to pay reasonable collection costs and attorneys' fees.
Warranty and workmanship
We stand behind our work. If something we did is not right, contact us within 7 days and we will come back and make it right, at no additional charge, at our sole discretion.
Landscaping is affected by weather, soil, irrigation, sunlight, pests, and other factors outside our control. We do not warrant the survival, growth, or long-term appearance of plants, sod, or seed, and we do not warrant work performed on materials or systems that were already in poor condition before we began.
Photos and marketing
We may take before-and-after photos of the work area for internal quality control and, occasionally, for promotional purposes (social media, our website, or estimates). Photos will not include people, addresses, license plates, or other identifying details unless you have given specific consent. If you would rather we not take photos of your project, tell us before we start and we will honor that.
Communications and text messages
By submitting the estimate form or otherwise contacting us, you agree that Battleborn LV Landscaping may contact you by phone call, SMS text message, or email at the phone number and email address you provided regarding your service request. Message and data rates may apply. Reply STOP at any time to opt out of text messages, or HELP for help.
Acceptable use of the Site
You agree not to misuse the Site — including attempting to break, disrupt, or gain unauthorized access to it, or using it for any unlawful purpose. All content on the Site (logos, text, images, and design) is owned by or licensed to Battleborn LV Landscaping and may not be copied, reused, or redistributed without permission.
Third-party links
The Site may link to third-party websites (for example, our Yelp page). We are not responsible for the content, policies, or practices of any third-party site.
Disclaimer of warranties
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses.
Limitation of liability
To the fullest extent permitted by law, Battleborn LV Landscaping's total liability for any claim arising out of or relating to the Site or the Services will not exceed the amount you paid us for the specific service that gave rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages. Nothing in these Terms limits any liability that cannot be limited under applicable law.
Governing law and disputes
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts.
Changes to these Terms
We may update these Terms from time to time. The "Effective" date at the top will reflect the most recent change. Continued use of the Site or Services after an update means you accept the updated Terms.
